In New York City, more construction-related deaths have taken place in the first five months of 2008 than in all of 2007.
We are shocked and deeply angered that, once again, construction companies and the City of New York, through its Buildings Department, have failed to protect site workers and nearby residents from the hazards of operating a tower crane. Less than three months after the March 15th 2008 catastrophe, in which a tower crane collapsed in midtown, killing seven, we now have another collapse that was, without doubt, preventable.
That the Buildings Department visited the job site repeatedly before today, as reported, is of no moment. The City is in the middle of one of the greatest building booms in its history. Until the Buildings Department can effectively inspect tower cranes, ensuring that they are properly secured, maintained, and operated, there is a real danger of future collapses like this one and the March 15th catastrophe.
As for the contractors responsible for this construction site and the operation of the crane, there can be no explanation for what happened this morning other than negligence and carelessness. A tower crane, weighing tons, should not fall from the sky, into peoples’ homes, and onto the street. The safety of pedestrians, residents and workers should not be sacrificed in the name of speed and profit. What today’s catastrophe proves, once again, is that the construction industry is incapable of policing itself.
Because City inspectors have failed to ensure site safety and the construction industry has failed to ensure the safety of workers and others, the only recourse that an injured victim or the family of someone killed has is New York’s civil justice system. Sullivan Papain is confident that a civil lawsuit is the only way to hold those responsible for today’s disaster accountable to the victims and their families.
Even as our investigation into the March 15th collapse continues, we are prepared to devote the full resources of Sullivan Papain to an investigation of this latest disaster, and to seek compensation for the injured and the families of the deceased.
