Further, to avoid violating discrimination laws, an employer should draft its policy to generally allow a clothing item worn for religious reasons, even if the item would not be allowed otherwise. Finally, an employer’s policy should state that the employer reserves the right to amend or modify the dress code policy at any time.

After the policy has been drafted, an employer should distribute a copy to all employees. An employer should also train supervisors and managers to ensure that expectations are consistent and that any issues are handled appropriately and with sensitivity.
