San Francisco – A federal judge has overturned the voter-approved ban on same-sex marriage in California. As reported by the Associated Press (AP), Chief U.S. District Judge Vaughn Walker ruled that Proposition 8 “legitimates” the unequal treatment of gays and lesbians.
Walker is quoted by the AP as stating in his opinion, “Proposition 8 singles out gays and lesbians and legitimates their unequal treatment… Proposition 8 perpetuates the stereotype that gays and lesbians are incapable of forming long-term loving relationships and that gays and lesbians are not good parents.”
Walker further wrote, “Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couples.”
Sponsors of the ban have reportedly stated they will appeal the ruling.
