The USASR Hip Settlement deadline is past, and many patients who had the DePuy ASR implanted are still suffering and missed the opportunity to file. Is all lost?
Not exactly. Victims are still retaining counsel and suing for damages privately, in what seems to be a new wave of claims resulting from faulty manufacturing and design of the DePuy ASR Hip. This new wave of claims isn’t bound by the Settlement Agreement put in place, and so plantiffs have an opportunity to revist other claims that were dismissed before–claims like negligence, fraud, and concealment. Attorneys are accepting these cases on contingency and are very optimistic about potential outcomes for their clients.
Walkup Law, a firm in California, is one such firm. Their website, www.walkuplawoffice.com, hosts a wealth of information for claimants about their options and the history of the ASR case.
Matthew Couch, owner of CFS Global, LLC, is optimistic about helping claimants get funding in advance of their pending suit. “Just because the deadline has passed doesn’t mean that claimants should give up,” he says. “Those with qualified cases are welcome to apply for a pre-trial advance on their anticipated award. Many of these plantiffs are disabled, unable to work, and getting dangerously close to being unable to pay bills. If we can help with that, we will.”
Revision surgery is often the next step for these victims, which takes time, money, and tends to put the victim out of work for even longer while they recover. Seeking advance funding for their pending suit can help some of these clients make ends meet while they wait for their settlement.
Claimants who file a formal complaint and are going forward with a suit may be able to seek advance funding for their claim. They can call Matthew Couch of CFS Global, LLC at 267-467-9286 or email in at firstname.lastname@example.org. A matrix is being implemented on the firm’s website, www.couchfinancial.com, to better handle inquiries specifically related to funding requests directly related to cases regrding the ASR Hip.
