Tyler, TX (Tyler Car Accident Attorney News)—Safety concerns are being raised about a Tyler intersection, where an elderly man was hit by a minivan and seriously injured on Tuesday, November 29, 2011. The East Texas senior is now in the ICU following the pedestrian accident at the intersection of Shiloh Road and Troup Highway, reports Tyler car accident attorney Gregg Price of PRW Lawyers.
According to information provided by KLTV, Gregory Burke, 65, of Tyler, was hit around 6:20 p.m. by a minivan, while crossing the busy intersection heading towards the Wal-Mart.
Burke reportedly made it across the first three lanes of the southbound traffic, when he was hit by the minivan in the southbound turn lane, Tyler Police stated.
Burke was rushed to an area hospital, where he is listed in critical condition and remains in the ICU.
KTLV talked to people who work near the intersection who revealed that, “…you have to wait for the cars to go by until it is clear and then when it is clear you go across. Then you stay in the middle and wait for those cars to cross and you get to cross then,” said Dawn Murphy.
“I have managed to cross the street with ease, not all the time but sometimes,” Murphy said to KLTV.
Apparently there is no crosswalk, making the intersection even more dangerous to pedestrians.
“Had a crosswalk been available at this heavily trafficked intersection, often used by pedestrians, this injury accident could have been avoided,” explains Tyler accident attorney Gregg Price. “It seems that area residents and people who work near the intersection have long dealt with the hazardous intersection, which should provide a safe place for pedestrians to cross.”
“While police believe that Burke is likely at fault for the accident since he was standing in the middle of the road, it begs the question as to whether the city is also at fault for not implementing a crosswalk for pedestrians,” the East Texas injury lawyer continued.
