Sometimes a car accident victim waits too long to file a lawsuit, and he then misses out on the compensation he is entitled to. As Dallas personal injury lawyer Amy Witherite explains, this can happen for several reasons:
The victim is overwhelmed with more pressing problems: pain, difficulty performing basic self-care tasks, stress about an inability to work, fear of medical debt, and concern over how to provide even the most basic necessities for a family’s survival.
The victim doesn’t know about the filing deadlines. Most people who are not lawyers do not know that different filing periods exist for different kinds of claims.
The victim is misinformed about filing deadlines. Sometimes a well-intentioned friend tells a victim false information. In reliance on that information, the victim waits too long to contact a lawyer.
The victim is indecisive. A victim might be ambivalent about filing a lawsuit and take too long making up his mind.
The victim is strung along by the other party’s insurance company. Sometimes an insurance company appears to be willing to help a victim, but it then takes too long to deliver on that promise. In the meantime, the victim misses the filing deadline.
Filing deadlines in Texas are firm; courts do not allow personal injury victims to file after the statutory period for filing has expired. If you’ve been injured, don’t wait to call for help.
