Three children were killed in a recent West Dallas car crash that investigators say was linked to criminal negligence. Reports say the children, all of whom were wearing seatbelts, died from the impact of being hit by a speeding driver.

“DALLAS — Dallas Police say they will refer three counts of criminally negligent homicide to the Dallas County District Attorney’s Office against a driver who hit a car and killed three children inside on Monday. Investigators say Xavier Taylor was speeding westbound on Singleton when he struck a Dodge Stratus driving by Maricela Mendoza.”
A fourth child who was also in the vehicle survived the accident, but was taken along with the mother of the children to the hospital for treatment. The suspect arrested in the crash was charged with three counts of manslaughter and booked into the Dallas County jail on more than a $300,000 bond.
Criminally Negligent Behavior and Serious Dallas Traffic Accidents
Statistics from the U.S. Department of Transportation National Highway Traffic Safety Administration show that approximately 6 million motor vehicle crashes occur in the United States each year. A majority of these accidents are non-injurious; however, over an estimated 1.6 million are. Of the high percentage of those that cause serious injuries and deaths, a significant number are attributed to criminally negligent behaviors. Acts like excessive speeding, driving while under the influence of drugs or alcohol, and disobeying traffic signals are among the types of negligence that often warrant criminal as well as civil action.
According to West Dallas crash attorney Amy Witherite, the city of Dallas sees many wrecks each year that are linked to criminal negligence. Says Witherite, “the number of personal injury cases we see each year because some driver chose to act completely recklessly still blows my mind even after many years of practice.” The attorney recently reported on another crash where charges were expected to result due to the gross misconduct of a driver in the publication, “Son Witnesses Parents Being Struck by Suspected Drunk Driver in Fatal Crash.”
Media reports say the 21-year-old son of a husband and wife who were killed while traveling on a motorcycle after a driver ran a red light personally witnessed their deaths.

“Me and my parents were talking about which way we were gonna go to the restaurant to get dinner. And then the light turned green and we took off… Got to the middle of the intersection and that’s when the car came up and t-boned them after running a red light.”
Witherite asserts, “It is important that victims in these types of crashes, or their loved ones in the event of wrongful death, are aware of the legal options available for pursuing financial damages to compensate them for what they have been forced to endure. A number of victims see the criminal aspect as justice enough; however, by also holding those accountable financially responsible, it also gives many the restitution they need to move forward in the best way possible after facing such a tragedy.”
