Hoda Muthana, who left the U.S. to join ISIL in 2014, has been in a lengthy legal battle to return to the country.

The U.S. Supreme Court has refused to hear the appeal of a woman who left the U.S. to enter ISIL (ISIS), but later ruled that she wanted to return to the country.

The Supreme Court judge refused to consider the appeal on Monday without comment Hoda Muthana, Was born in New Jersey in October 1994 to a Yemeni diplomat and grew up in Birmingham, Alabama.

Muthana left the U.S. in 2014 to join ISIL after apparently radicalizing the network.

While abroad, the government determined that he was not a U.S. citizen and revoked his passport, citing his status as a diplomat at the time his father was born. His family sued to return to the United States.

A federal judge ruled in 2019 that the U.S. government had correctly determined that it was Muthana not a U.S. citizen despite being born in the country. Children of diplomats are not entitled to birthright citizenship.

The family’s lawyers appealed, arguing that his father’s diplomatic status in the United Nations had ended before he was born, automatically becoming a citizen.

Muthana surrendered to the US-backed Syrian Democratic Forces, saying ISIL fighters were losing the last self-proclaimed caliphate in Iraq and Syria and were going to refugee camps.

Muthana said she regretted her decision to join the group and wanted to return to the U.S. with her young child, the son of a man she met while living with the group. The man died later.

His current whereabouts are unclear.

Christina Jump, a lawyer for the Constitutional Law Center for American Muslims, did not immediately send an e-mail to the Associated Press on Tuesday asking for comments.

The decision to revoke his passport was taken under the orders of former President Barack Obama.

The case received widespread attention because President Donald Trump tweeted about it, saying he had given the Secretary of State permission to return to the country.
