A New York State Attorney General said Tuesday that Andrew Cuomo was removing a criminal charge against former New York Governor accused of initiating a criminal charge after concluding that the burden of proof could not be met in court.
Albany County Attorney David Soares’ decision came three days before the former Democrat governor had to answer for the offense in court, following a decision by other state prosecutors to drop a similar charge.
“Although we found the complaint to be cooperative and credible in this case, after examining all the available evidence, we concluded that we could not meet our burden at trial,” Soares said in a statement.
Soares said he was “very concerned” about the allegation, but was asking the Albany sheriff to dismiss the complaint filed in October.

On Monday, Cuomo’s attorney said the Manhattan District Attorney’s Office said it had closed an investigation into how the Cuomo office handled nursing homes in the coronavirus pandemic. The office declined to comment and did not disclose what he was doing.
