Ocado has won a patent infringement lawsuit against ITS AutoStore By Reuters

(Reuters) – British supermarket group Ocado (LON 🙂 Group Plc said on Monday that it had won a patent infringement lawsuit filed by the Norwegian robotics company AutoStore Holdings Ltd with the Norwegian International AutoStore Holdings Ltd (ITC).

AutoStor filed the lawsuit last year in both the United States and the United Kingdom, claiming that it was the inventor and legal owner of some of the patents filed by Ocado.

The ITC High Court of Administrative Law ruled that three of the four AutoStore patents were invalid, saying that Ocado had not infringed the fourth, the British company said in a statement. The AutoStore dismissed a fifth patent claim the night before the trial.

The AutoStore said it intends to challenge the decision before the full committee, which will review the findings and issue a final ruling in April 2022.

“Today’s decision does not affect AutoStor’s ability to sell its product in the U.S. or worldwide,” the Norwegian company said Monday night.

The court also denied AutoStore’s request to ban the manufacture and sale of the products involved to Ocado and its partners and to ban their importation into the United States.

“We have consistently stated that Ocado is not violating a valid AutoStore IP, and we are pleased that the judge has now agreed with us,” an Ocado spokesman said.

The supermarket group has said it continues to pursue claims against AutoStore for infringing its patents in Europe and the United States.
