Brussels will sue AstraZeneca for breaching its EU-wide supply of vaccines, and imposed a brutal judicial battle after months of bitter disputes over major shortcomings.
The company immediately responded that it regretted it and would “strongly defend” it against lawsuits it considered “without merit”.
The European Commission announced on Monday that it had taken legal action on behalf of itself and the 27 EU member states.
“Some of the terms of the contract have not been met and the company has not come up with a reliable strategy for timely delivery of doses,” the committee said.
“What matters in this case is that we want to make sure that a quick number of doses are delivered to European citizens who are entitled to and mandated under the contract,” he added.
It is likely that AstraZeneca will not award more than a third of the original 300m dose in the EU supply contract at the end of June.
The company stressed that it had “fully complied” with the supply agreement, according to which it undertook to make “best reasonable efforts” to meet the delivery targets.
“Vaccines are difficult to manufacture, as evidenced by the supply challenges facing many companies in Europe and around the world,” AstraZeneca said in a statement. “We are making progress in meeting technical challenges and improving our output, but the production cycle of a vaccine is very long, which means that these improvements need time to increase the doses of vaccine completed.”
