US judge overturns California ban on weapons of attack | Gun Violence News

The three-decade ban on assault weapons was lifted, leading to the disapproval of the Democratic governor of the state.

A federal judge has ruled that California banned assault weapons three decades ago, and ruled that Gavin Newsom, who rejected the order, violated the constitutional right to give arms to the Democratic state governor.

U.S. District Court Judge Roger Benitez of San Diego ruled that the definition of illegal military-style rifles in the state removes Californians who abide by illegal laws in most other states and removes weapons normally approved by the U.S. Supreme Court.

“The law can’t survive,” Benitez said Friday. He finally gave the order to enforce the law, but he stayed for 30 days to give Rob Bonta the state attorney general time to appeal.

Governor Newsom said it is “a direct threat to public safety and the lives of innocent Californians.”

In a 94-page ruling, the judge ruled in favor of modern weapons, saying they were fully used for legal reasons.

“Like the Swiss Army knife, the popular AR-15 rifle is the perfect combination of a home defense weapon and a homeland defense equipment. Good for both home and combat,” the judge said in his presentation of the ruling.

That comparison “completely undermines the credibility of this decision and is a blow to families who have lost loved ones as a result of this weapon,” Newsom said in a statement.

The decision is escalating gun violence across the United States and just over a week after sad and armed California public transportation workers killed and shot nine people.

A search of the home of the shooter this week – which erupted before the attack began – found 12 weapons, about 22,000 rounds of ammunition and suspicious Molotov cocktails.

Massive shootings have also taken place in Florida, Indiana, California, Colorado and Georgia, amid a plethora of violence that President Joe Biden called an “epidemic”.

The U.S. Supreme Court will have to hear the challenge backed by the gun lobby of a New York law that restricts the carrying of firearms outside the home.

It will be the first major case of the Second Constitutional Right to bear arms heard by the nation’s highest court for more than a decade.

As the coronavirus pandemic slowed work violence as more people stopped, it also saw a record number of gun sales.

In March last year, the number of federal precedents made weekly by gun buyers was more than a million for the first time, The New York Times reported.
