(Reuters) – Google is appealing to the European Union’s Supreme Court against a decision to uphold a $ 2.8 billion competition fine, a spokesman for Alphabet (NASDAQ 🙂 said Thursday night, the company’s second bid to overturn the penalty. .

EU Competition Commissioner Margrethe Vestager fined the world’s most popular Internet search engine in 2017 for using its own price comparison shopping service to gain an unfair advantage over Europe’s smallest rivals.

The case is the first of three decisions by Google to raise 8.25 billion euros over the last decade in EU anti-competitive fines.

In November, the EU High Court largely dismissed Google’s appeal against the fine, saying the European Commission had rightly found that the company’s practices were detrimental to competition.

Luxembourg’s judges rejected the company’s argument that the presence of trading platforms showed a lot of competition.

“After careful consideration, we have decided to appeal the decision of the High Court, as we believe that the European Court of Justice has identified areas for legal clarification,” a Google spokesman said in a statement.

“Regardless of the appeal, we continue to invest in our remedy, which has been operating successfully for many years, and we will continue to work constructively with the European Commission.”

The court’s ruling in November could also strengthen Vestager’s hand in research on Amazon (NASDAQ :), Apple (NASDAQ 🙂 and Facebook (NASDAQ :).
