Lance LoRusso, Rolfe’s lawyer, said the commission’s decision would mean that the police would not return to the job immediately, but would remain on administrative leave until the outcome of the charges against him.

Rolfe was charged with fleeing police on June 12 after he was shot twice in the back. Brooks, who had more than a legal limit on alcohol in his blood, fell asleep in his car, blocking the lane of the car at Wendy’s restaurant.
